Joanne Tran

Joanne Tran is a shareholder with Stream Kim specializing in public entity defense including claims involving police liability, personal injury, dangerous conditions of public property, and employment matters. Her practice also includes commercial litigation and real estate litigation.  Ms. Tran regularly advises and represents clients in all aspects of litigation from the initial investigation of claims through law and motion, discovery, summary judgment, alternative dispute resolution, trial and appeals in both Federal and State court.

Prior to joining Stream Kim, Ms. Tran was a partner at two Bay Area law firms where her practice was devoted to the defense of claims against public entities, including counties, cities and police departments. While in law school, Ms. Tran clerked for the Alameda County District Attorney’s Office, and she completed a post-bar fellowship with the San Francisco District Attorney’s Office.

• Co-chaired a jury trial in an action involving a police detention of plaintiff for a mental health evaluation under Welfare and Institutions Code section 5150. Plaintiff alleged the officers illegally entered her home and used excessive force against her during the illegal detention and arrest. The jury deliberated for 30 minutes before returning a unanimous defense verdict and judgment was entered against plaintiff.
• Co-chaired a jury trial in a case stemming from a police detention of plaintiff for a mental health evaluation. Plaintiff claimed the officer used unreasonable force while illegally detaining her and caused her severe emotional distress. The jury deliberated for 1 hour before returning a unanimous defense verdict. Plaintiff appealed and the California Court of Appeal affirmed the trial court’s judgment against plaintiff.
• Represented the City and police officer in an action involving a plaintiff who claimed false detention, false arrest, excessive force, negligence and intentional infliction of emotional distress by a police officer following an arrest for battery against mall security guards and resisting/delaying/obstructing the officer’s investigation. Summary judgment was granted in favor of the City and police officer.
• Represented the City in a case where pedestrian plaintiff was struck by a vehicle while crossing an intersection. Plaintiff alleged the crosswalk was a dangerous condition of public property. Summary judgment was granted in favor of the City.
• Represented the City and police officers in a case arising from police removal of a child from his parents’ custody and placement of the child in child protective services after investigating a call of child abuse. Obtained dismissal with prejudice via motion to dismiss.
